» Keep up with the latest in this eminent domain case

On March 11, the Federal Energy Regulatory Commission (FERC) approved Kinder Morgan’s application to build the CT Expansion Pipeline project, one segment of which would be a 4 mile “gas storage” pipeline loop through Otis State Forest in Sandisfield, Massachusetts, which contains one of the last remaining stands of Old Growth Forest in the state.

Kinder Morgan has recently won an eminent domain proceeding and continues to request immediate access to begin construction (tree felling, blasting, etc.) on this property, circumventing protections put in place by Article 97 of the Massachusetts State Constitution and despite still not having all its other required certificates in place.

This is the first challenge to our Constitutional protections, and could set a precedent for the much larger Northeast Energy Direct (NED) pipeline still under consideration with FERC.

SANDISFIELD CONSERVATION COMMISSION
Come to the Sandisfield Conservation Commission meetings.
Kinder Morgan has asked to be a standing item on the agenda for the next 7 months of Con Comm meetings.  Activists joined the meeting to witness the proceedings in June, helping local commission members stick to their guns in standing up to KM / TGP’s requests for lax procedure in addressing the Enforcement Order.
